මානව හිමිකම් සහ ආර්ථිකය

යුරෝපා කොමිසම විසින් 2020 පෙබරවාරි 10 වන දින ශ්‍රී ලංකාවේ වර්ෂ 2018-2019 කාලය තුළ ජී එස් පී + ක්‍රියාකාරීත්වය සහ ශ්‍රී ලංකාව අත්සන් කළ සම්මුතීන් වල ක්‍රියාකාරීත්වය පිලිබඳ වාර්තාවක් ඉදිරිපත් කර තිබේ.
සිවිල් සහ දේශපාලන අයිතීන් පිලිබඳ ජ්‍යාත්‍යන්තර සම්මුතිය, වධ හිංසාවට ලක්කිරීමට එරෙහි ජාත්‍යන්තර සම්මුතිය සහ ළමුන්ගේ අයිතිවාසිකම් පිලිබඳ සම්මුතිය යන ශ්‍රී ලංකාව විසින් අත්සන් කරණ ලද ජාත්‍යන්තර සම්මුතීන්ට අනුකූලව ක්‍රියා නොකිරීම හේතුවෙන් ශ්‍රී ලංකාවට යුරෝපා සංගමය මගින් ලබාදුන් ජී එස් පී + සහනය වර්ෂ 2010 දී  අත් හිටුවන ලදී.
ජී එස් පී + යටතේ ශ්‍රී ලංකා අපනයන වලට යුරෝපා සංගමය මගින් ප්‍රදානය කළ තීරු බදු සහනය අනුව බොහෝ භාණ්ඩ වලට කිසිම තීරුබදු අයකිරීමක් නොකෙරුණි.  එමෙන්ම ශ්‍රී ලංකාවෙන් යුරෝපා සංගමයට අපනයනය කරණ භාණ්ඩ ශ්‍රී ලංකාවේ මුළු අපනයනයෙන් 1/3 ක් පමණ විය. එවකට තිබූ ආණ්ඩුව ජී එස් පී + සහනය ලබාදීම වෙනුවෙන් යුරෝපා සංගමය විසින් පනවන ලද කොන්දේසි අනුව කටයුතු කිරීමේදී ශ්‍රී ලංකාවේ ස්වෛරීත්වය කැප කිරීමට සිදුවන බව පවසමින් එම සහනය නැවත ලබා ගැනීම වෙනුවෙන් උත්සාහයක් ගත්තේ නැත. 
යුරෝපා සංගමය ඉල්ලා සිටියේ ජී එස් පී + සහනය ලබාදීම වෙනුවෙන් ශ්‍රී ලංකාව විසින් එවකට එකඟවී අත්සන් කර තිබුණු ජාත්‍යන්තර සම්මුතීන් 27 ක් සක්‍රිය ලෙස ක්‍රියාත්මක කරණ ලෙසය.
ශ්‍රී ලංකාව විසින් අත්සන් කර තිබූ ජාත්‍යන්තර සම්මුතීන් බලාත්මක කිරීම සඳහා ගාස්තුවක් හෝ කප්පමක් හෝ වශයෙන් ශ්‍රී ලංකාවට ජී එස් පී + සහනය ලබාදීමට එනම් ශ්‍රී ලංකාවෙන් යුරෝපා සංගමයට අපනයනය කරණ භාණ්ඩ බොහොමයක තීරුබදු ඉවත් කිරීමට යුරෝපා සංගමය කැමැත්ත ප්‍රකාශ කිරීම හරහා මතුවන ශ්‍රී ලංකාවේ ජාත්‍යන්තර ප්‍රතිරූපය කෙබඳුද? ශ්‍රී ලංකාව ජාත්‍යන්තර සම්මුතීන්ට අත්සන් කලේ නම් ඒවා ක්‍රියාත්මක කළ යුතුය. කිසිවකු විසින් ඒ සඳහා කප්පම් ගෙවිය යුතු නොවේ. මෙම සම්මුතීන් මගින් ශ්‍රී ලංකාවේ සහ ශ්‍රී ලාංකිකයන්ගේ මානව හිමිකම්, කම්කරු අයිතිවාසිකම්, යහපාලනය, පරිසරය සහ ධරණීය සංවර්ධනය යන කරුණු ආවරණය වේ. මේ සම්මුතීන් ක්‍රියාත්මක කිරීම මගින් සහන සැලසෙන්නේ ශ්‍රී ලංකාවට සහ ශ්‍රී  ලාංකිකයන්ටයි. යුරෝපා සංගමයට නොවේ. එපමණක් නොවේ. ජී එස් පී + සහනය මගින්  නැවත ශ්‍රී ලංකා ආර්ථිකයට සහ ශ්‍රී ලාංකිකයන්ට ප්‍රතිලාභ ලැබේ. යුරෝපා සංගමයට ලැබෙන ප්‍රතිලාභයක් නැත.
ශ්‍රී ලංකාව මේ අවස්ථාවේදී ජී එස් පී + සහනය වෙනුවෙන් මෙම සම්මුතීන් ක්‍රියාත්මක කිරීම නිසා සිය  ස්වෛරීත්වයට හානි සිදුවන බව පවසමින් සම්මුතීන් ක්‍රියාත්මක කිරීම පැහැර හැරියේය.
යුරෝපා සංගමය ඇත්ත වශයෙන්ම පෙනී සිටියේ සිය ප්‍රජාතන්ත්‍රවාදී රාජ්‍යය තුලම මර්දනයට ලක්වී සිටි පිඩිත සහ දුර්වල ජන කොටස් වෙනුවෙනි. මෙම පීඩිතයන්  වාර්ගික හෝ ආගමික සුළු ජන කොටස් හෝ ස්ත්‍රීන් හෝ දරුවන් හෝ වෘත්තීය සමිති හෝ විය හැක. 
ප්‍රජාතාන්ත්‍රික රාජ්‍යයක ප්‍රධාන කුළුණු තුනක් තිබේ. එනම් විධායකය, ව්‍යවස්ථාදායකය සහ අධිකරණයයි. එයට අමතරව මාධ්‍යය ද ක්‍රියාත්මක වේ. මෙයින් එක් ආයතනයක්  විසින් අනෙක් ආයතන අතික්‍රමණය කිරීම වැළැක්වීම සඳහා ව්‍යවස්ථාවට  සංවරණ සහ තුලන  හඳුන්වාදී ඇත. මේ මගින්  ජනතාව සතු ස්වෛරීත්වය ආරක්ෂා වී තිබේ. යුරෝපා සංගමයේ හෝ එක්සත් ජාතීන්ගේ හෝ ක්‍රියාවන් ව්‍යවස්ථාවට පරිබාහිරව ජනතාව මර්දනයෙන් වැළැක්වීම සඳහා ඇතිවූ යම් සංවරණ සහ තුලන ක්‍රියාවලියකි. ජනතාව මර්දනයෙන් වැළැක්වීම මගින් ඔවුන්ගේ ස්වෛරීත්වය ආරක්ෂා වේ. 
මේ මගින් යුරෝපා සංගමයට ලැබෙන ප්‍රතිලාභය කුමක් දැයි යමකු අසනු ඇත. එයට පිළිතුර වන්නේ තමන් අගය කරණ ප්‍රතිපත්තීන් සහ හර පද්ධතීන් තවත් අයකු විසින් ක්‍රියාත්මක කරනු ලැබීමේ සන්තෝෂයයි.
පසුගිය යහපාලන ආණ්ඩුව විසින් එතෙක් පැවති ක්‍රියා පිළිවෙල ආපසු හරවා නැවත ජී එස් පී + සහනය ලබාගෙන ශ්‍රී ලංකාව අත්සන් කළ ජාත්‍යන්තර සම්මුතීන් ක්‍රියාත්මක කිරීම අරඹන ලදී. මේ අනුව ශ්‍රී ලාංකිකයන්ට ද්විත්ව සහනයක් ලැබිණ. එනම් තීරුබදු සහනය සහ ජාත්‍යන්තර සම්මුතීන් ක්‍රියාත්මක කිරීම මගින් ලැබෙන නිදහසේ සහනයයි.
යුරෝපා සංගමයේ වාර්තාව නිකුත් වන්නේ පසුගිය වසර දෙකේ ප්‍රගතිය සමාලෝචනය කිරීම සඳහාය.මෙම වාර්තාව බොහෝ සෙයින් ම  අදාලවනුයේ පසුගිය ආණ්ඩු කාලයටයි. වාර්තාව මගින් ආණ්ඩුවේ සාධනීය ක්‍රියා  ප්‍රශංසා වට ලක් කර ඇති අතර වඩා දියුණු කළ යුතු අංග අවධානයට ලක් කර තිබේ.
“ශ්‍රී ලංකාව බෙහෝ සාධනීය පියවර ගෙන ඇත: අතුරුදහන් වූවන්ගේ කාර්යාලය සහ හානි පූරණය සඳහා වන කාර්යාලය පිහිටුවා තිබීම; වධ හිංසාවට එරෙහි එක්සත් ජාතීන්ගේ සම්මුතියේ විකල්ප කෙටුම්පත අනුමත කිරීම; බලහත්කාරයෙන් අතුරුදහන් කරවූවන් සම්බන්ධ පනත සහ තොරතුරු දැනගැනීමේ පනත සම්මත කර ගැනීම; මගින් විනිවිද භාවය සහ ප්‍රජාතන්ත්‍රවාදය උදෙසා බලවත් කැපවීමක් පෙන්නුම් කරයි. එනමුත් විශේෂයෙන්ම වගවීමේ ක්‍රියාවලිය සම්බන්ධව  ප්‍රගතිය ස්ථාවර නැත. පාස්කු ඉරිදා ප්‍රහාර වලින් පසුව සුළු ජාතීන්ගේ තත්ත්වය නොසන්සුන් වී ඇත. වධ හිංසාවට ලක්වීම වැළැක්වීම න්‍යාය පත්‍රයේ ඇත. එනමුත් වගවීම සම්බන්ධයෙන් වන ක්‍රියාකාරකම් ඉක්මන් කළ යුතුව ඇත.”
“සමස්තයක් වශයෙන් වර්ෂ 2015 සිට ශ්‍රී ලංකාවේ මානව හිමිකම්වල  සහ යහ පාලනයේ වර්ධනයක් පෙන්නුම් කරයි. එනමුත්  අසතුටු දායක තත්ත්වයන් කිහිපයක් තිබේ.”
පසුගිය ජනාධිපතිවරණයෙන් පසුව සිවිල් සමාජයට සහ මානව හිමිකම් සුරකින්නන්ට ක්‍රියාත්මක වීමට තිබූ අවකාශය අවහිර නොකිරීමේ වැදගත් බව පිළිබඳව වාර්තාව අවධාරණය කරයි. එනමුත් දිගටම එක්සත් ජාතීන් සමඟ එක්ව කටයුතු කිරීමේ අවශ්‍යතාවද ජාත්‍යන්තර මානව හිමිකම් කොමිසමේ 30/1  යෝජනාව ක්‍රියාත්මක කිරීමේ අවශ්‍යතාවද වාර්තාව පෙන්වා දෙයි.
මේ අතර ශ්‍රී ලංකාවේ සම සහභාගිත්වයෙන් මානව හිමිකම් කොමිසමට ඉදිරිපත් කරණ ලද මෙම යෝජනාවෙන් ඉවත්වන බව  ශ්‍රී ලංකා ආණ්ඩුව පසුගියදා නිවේදනය කළේය.
ළමා ශ්‍රමය නැති කිරීම, කම්කරු අයිතිවාසිකම් ගෘහස්ත හිංසනය සහ කාන්තා දේශපාලන නියෝජිතයන්ට හිමි පංගුව සම්බන්ධ කාරනා වලදී ප්‍රගතියක් පෙන්නුම් කර ඇතැයි වාර්තාව සඳහන් කරයි.
විධායක ජනාධිපති ක්‍රමය සංශෝධනය කළ එමෙන්ම ප්‍රජාතන්ත්‍රවාදය සහ යුක්තිය සුරැකීම සම්බන්ධයෙන් ප්‍රමුඛ කාර්ය භාරයක් ඉටුකරන යම් ආයතන වල ස්වාධීනත්වය තහවුරු කරණ 19 ව්‍යවස්ථා සංශෝධනය අහෝසි කිරීමේ වෑයම පිළිබඳව වාර්තාව කනස්සල්ල පළ කරයි.
ඥානසාර හිමියන්ට සමාව දීම ගැන සඳහන් කරණ වාර්තාව එය අධිකරණය ටත් ඥානසාර හිමියන් ගේ ක්‍රියා හේතුවෙන් වින්දිතයන් වූ මුස්ලිම් වරුන්ටත් කනස්සළු දායක පණිවිඩයක් නිකුත් කරණ බව කියයි. එමෙන්ම ශක්තික සත්කුමාර අත්අඩංගුවට පත්වීම පිළිබඳවද වාර්තාව සඳහන් කරයි.
ආගමික නිදහස ගැන කටයුතු කරණ රාජ්‍ය නොවන සංවිධානයක් වර්ෂ 2018 ජනවාරි මස සිට  ක්‍රිස්තියානීන් ඉලක්ක කරගෙන සිදුකළ තර්ජනය කිරීම් සහ ආගමික මෙහෙයයන් කඩාකප්පල් කිරීම් 86 ක් වාර්තා වූ බව සඳහන් කරණ වාර්තාව 2019 අප්‍රේල් 14 වනදා මෙතෝදිස්ත සභාවේ ආගමික මධ්‍යස්ථානය කට ගල් සහ රතිඤ්ඤා වලින් කළ පහර දීම ගැනද සඳහන් කරයි. 
පසුගිය ආණ්ඩුව ත්‍රස්තවාදය වැළැක්වීමේ පනත ඉවත් කර වෙනත් පනතක් ගෙන ඒමට උත්සාහ ගත්තත් පවතින ආණ්ඩුව වැඩිදියුණු කළ කෙටුම්පතක් ඉදිරිපත් කරණ තෙක් පවතින පනත පවත්වාගෙන යන බව ප්‍රකාශ කළ බවද වාර්තාව සඳහන් කරයි.
ද්‍රවිඩ ජනතාවගේ ඉඩම් නිදහස් කිරීම ගැන සඳහන් කරණ වාර්තාව විදේශ ඇමතිවරයාට අනුව 2019 මාර්තු 12 වන විට රාජ්‍ය ඉඩම් වලින් 88.87% ක්ද පුද්ගලික ඉඩම්වලින්   92.16% ක් ද නිදහස් කර ඇති බව කියයි    
මුස්ලිම් විවාහ සහ දික්කසාද පනත සංශෝධනය කිරීමේ අවශ්‍යතාව ද වාර්තාව අවධාරණය කරයි.
එමෙන්ම ළමයින්ට එරෙහිව ක්‍රියාත්මක වන ශාරීරික දඬුවම් ද ලිංගික අපයෝජනයද ආර්ථික සූරා කෑම ද සම්බන්ධයෙන් ඉක්මන් අවධානයේ අවශ්‍යතාව වාර්තාව අවධාරණය කරයි.
ශ්‍රී ලංකාවේ ව්‍යවස්ථාවේ සඳහන් වුනද ජන වර්ගය සහ ආගම වැනි කරුණු හෝ වෘත්තීය සමිතියකට අයත්වීම සහ දේශපාලන මත දැරීම හෝ වැනි විවිධ කාරනා සම්බන්ධ වෙනස්කොට සැලකීමට එරෙහි නීතියක් නොමැති කම වාර්තාව පෙන්වා දෙයි. 
එමෙන්ම ස්ත්‍රීන්ට සහ පුරුෂයන්ට සමාන වැඩට සමාන වැටුප් ලබා දිය යුතු බවට නීතියක්ද නොමැති බව ද ලිංගික අතවර වලින් සේවක සේවිකාවන් ආරක්ෂා කිරීමට ප්‍රතිපාදන නොමැති බවද වාර්තාව  පෙන්වා දෙයි.
එමෙන්ම අල්ලා ගත් නීති විරෝධී ඇත්දළ තොගයක් ප්‍රසිද්ධියේ විනාශ කිරීම පිළිබඳව වාර්තාව ප්‍රශංසා කරයි.
වාර්තාව විසින් මතු කරණ ලද සියළුම කරුණු ශ්‍රී ලංකාව විසින් අත්සන් කළ සම්මුතීන් 27 ක්‍රියාත්මක කිරීමට අදාලවේ. එම වපසරියට පිටින් කිසිවක් වාර්තාවේ සාකච්ඡා කර නැත.
ශ්‍රී ලංකාවට ජී එස් පී + සහනය වෙනුවෙන් ලැබුන ආර්ථික ප්‍රතිලාභ වාර්තාවේ පහත දැක්වෙන ලෙස පෙන්වා දී ඇත.
“ශ්‍රී ලංකාවේ සමස්ත වෙළෙඳාම 2017 සිට 2018 දක්වා  යුරෝ බිලියන 29.1  කින් වැඩිවී ඇත. මෙය 3% ක වර්ධනයකි. සමස්ත වෙළෙඳ ශේෂයේ හිඟය යුරෝ බිලියන 9 කි.  වර්ෂ 2018 දී යුරෝපා සංගමය ශ්‍රී ලංකාවේ විශාල තම වෙළෙඳ සහකරුවා විය. මෙය ශ්‍රී ලංකාවේ සමස්ත වෙළෙඳාමෙන්  16% කි.  වටිනාකම යුරෝ බිලියන 4.7 කි. මේ අනුව යුරෝපා සංගමය ඉන්දියාවටද(14.6%)  චීනයටද (13.4%) ඇමෙරිකාවටද (10.2%) වඩා ඉදිරියෙන් සිටී. මෙතෙක් දුරට ශ්‍රී ලංකාවේ අපනයන වලින් වැඩිම ප්‍රමාණයක් එනම් 30% කට වඩා වැඩි ප්‍රමාණයක් ආනයනය කරන්නේ යුරෝපා සංගමයයි. වටිනාකම යුරෝ බිලියන 2.8 කි. ඇමෙරිකා එක්සත් ජනපදයට ශ්‍රී ලංකාවේ අපනයන 26% ක්ද ඉන්දියාවට6.6% ක්ද වේ. ශ්‍රී ලංකාවේ ආනයන සම්බන්ධයෙන් චීනය ඉදිරියෙන් 
වාර්තාව සඳහන් කරණ සමස්ත වෙළෙඳාම යනු ආනයන සහ අපනයන යන දෙකේ එකතුවයි.
එමෙන්ම ශ්‍රී ලංකාවේ යුරෝපා සංගමයට කෙරෙන අපනයන වලින් වැඩි කොටස එනම් 2018 දී  84% ක් ජී එස් පී + සහනය සඳහා සුදුසුකම් ලබන්නේ වුවද එය පාවිච්චි කිරීමේ අනුපාතය (එනම් ශ්‍රී ලංකාවේ සහනය සඳහා සුදුසුකම් ලබන අපනයන වලින් සහනය ලැබූ අපනයන අනුපාතය) 60% කින් පමණ වැඩි කිරීමේ අවකාශයක් තිබේ. කෙසේ නමුත් මෙම පාවිච්චි කිරීමේ අනුපාතය පසුගිය වසර තුනේ අනුක්‍රමයෙන් වැඩිවී තිබේ. ජී එස් පී + සහනය යටතේ ශ්‍රී ලංකාවෙන් වැඩිපුරම අපනයනය කෙරෙන්නේ නිමි ඇඳුම් (54%) සහ රබර්(19%)  ය.
පසුගිය ආණ්ඩුව මෙම මූලික අයිතිවාසිකම් සුරක්ෂිත කිරීමේ ලා දැක්වූ මන්දගාමී ස්වරූපය අපි දනිමු. එක් අතකින් අපගේ පුරවැසියන්ගේ මූලික අයිතීන් සුරැකීම සම්බන්ධයෙන් එක්සත් ජාතීන් සහ යුරෝපා සංගමයේ ක්‍රියාකාරීත්වය සම්බන්ධව අපි ලැජ්ජාවට පත් විය යුතු වමු. ඇත්ත වශයෙන්ම එක්සත් ජාතීන් සහ යුරෝපා සංගමය අප පුරවැසියන්ගේ ස්වෛරීත්වය සුරැකීමට උත්සාහ කරණ අතර මෙරට සමහර කොටස් රාජ්‍යයේ ස්වෛරීත්වය සුරැකීමේ මුවාවෙන් එයට විරුද්ධ වෙති. මෙම වාර්තාව ශ්‍රී ලංකාව විසින් අත්සන් කරණ ලද ජාත්‍යන්තර සම්මුතීන් වල ක්‍රියාකාරීත්වය සම්බන්ධ පැතිරුණු ස්වභාවයද ආර්ථික ප්‍රතිලාභ වල වර්ධනයද පෙන්නුම් කරයි. එමෙන්ම වර්තමාන ආණ්ඩුවේ වගකීම වන්නේ පසුගිය ආණ්ඩුවේ ක්‍රියා පිළිවෙල ඉදිරියට ගෙනයාම මිස එය කඩාකප්පල් කර ප්‍රවාහය ආපසු නොහැරවීම බව මෙම වාර්තාව මගින් පෙන්වා දෙනු ලැබේ.

Human Rights & Economic Benefits

On February 10, 2020 the European Commission issued a Joint Report to the European Parliament and the Council on the Generalised Scheme of Preferences covering the period 2018-2019 on Sri Lanka.
The European Union granted GSP+ concession to Sri Lanka on the understanding that Sri Lanka would honor 27 international conventions Sri Lanka has already signed. However, the EU has withdrawn the GSP + concession in 2010 on the grounds that Sri Lanka has not adhered to three conventions out of those 27 conventions, namely International Covenant on Civil and Political Rights, Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment and Convention on the Rights of the Child

According to the EU concessions under GSP+ there were no import duty for many goods imported by the EU from Sri Lanka. Exports to the EU from Sri Lanka accounts for around 1/3 of total exports of Sri Lanka. The government at the time did not take any initiative to get the GSP + concessions back in the pretext that the country will have to sacrifice its sovereignty in fulfilling the conditions attached to those concessions. 
The only condition imposed by the agreement was that in return Sri Lanka should execute the 27 international conventions Sri Lanka has already signed.
If the EU had to offer additional economic concessions for Sri Lanka to adhere to the international conventions it had already signed, what was the international credibility Sri Lanka had. If the conventions were signed, requirements of those must have been implemented. Those conventions were of human rights, labour rights, good governance, sustainable development and environment protection of Sri Lanka and its citizens. The beneficiaries of implementing these conventions were Sri Lankan citizens and eventually Sri Lanka, not the citizens of the EU. Not only that, the beneficiaries of the concessions also were Sri Lankan citizens and Sri Lankan economy, not the EU.
Sri Lanka at this point said that by getting the concessions and implementing the conventions, its sovereignty would get affected and therefore it would refrain from getting the concessions
The EU in fact advocated on behalf of the people who were suppressed in their own country. They are upholding the rights of the minorities and the weak. It can be ethnic minorities, women trade unions or the children.
In a Democracy there are three main pillars, the Executive, the Legislature and the Judiciary. In addition to that there is Media. There are checks and balances operating in a constitution to ensure that one pillar of the Democracy does not dominate the other two pillars. This is to ensure that the people who hold the sovereignty are served better. This is a situation where checks and balances come from outside of the Democracy to safeguard the people who hold the sovereignty from the trustees those very people have appointed.
One may ask what the EU gets out of this. The EU gets the satisfaction of implementation of the values they appreciate in Sri Lanka as well.
The previous Government reversed the process, regained the GSP+ concessions and started fulfilling the requirements outlined in those conventions and thereby Sri Lankan citizens got double benefits, benefits of GSP+ and the benefits of implementation of those conventions.
The report of the European Union was released in order to evaluate the progress of the past two years. The period of coverage of the report was mostly the tenure of the previous government. It praised the positive steps taken by the government and at the same time it pointed out the areas to be focused.
 “Sri Lanka has taken several positive steps: the Office on Missing Persons and the Office for Reparations are in place; the accession to the Optional Protocol to the UN Convention Against Torture (OPCAT) came into effect; the adoption of Enforced Disappearances Act and the Right to Information Act reflect strong commitments to democracy and transparency. Yet, progress is fragile, especially with regard to accountability. In the aftermath of the Easter Sunday terrorist attacks, the situation of minorities has become tense. Prevention of torture is on the agenda, but actions need to be stepped up in terms of accountability.”
 “Overall, the human rights and good governance situation in Sri Lanka has improved since 2015. Still, several concerns remain.”
The report pointed out that it was crucial to preserve the civil society space and the capacity of human rights defenders to pursue their regular activities following the election of the new President in November 2019. It also emphasized the importance of maintaining continued engagement with the UN as well as to demonstrating full commitment to the implementation of the Human Rights Council resolution 30/1 on Promoting reconciliation, accountability, and human rights.  
In the meantime, the Sri Lankan government announced that it will withdraw from the co -sponsorship of the Human Rights Council resolution 30/1 with immediate effect. 
Several other highlights of the report were as follows
 A progress in the areas of eradication of child labour, labour rights, laws against domestic violence and the quota for women elected in office in Local Government bodies and Parliament.
Concern about possible abolishment of the 19th Constitutional Amendment, which reformed the executive Presidential system and enhanced the independence of certain institutions that are instrumental for democracy and justice. 
The presidential pardon granted to Ven Gnanasara sent a worrying message to Sri Lanka’s judiciary and to the country’s Muslim community who have been victims of mob violence instigated by Gnanasara Thera. It commented about the arrest of Shakthika Sathkumara as well.
The fact that a  non-governmental organization working on freedom of religion had documented 86 incidents targeting Christians, including threats and disruption of religious services. A Methodist prayer center was pelted with stones and firecrackers.
The attempt by the previous government  to introduce a new Act repealing the Prevention of Terrorism Act, but the new government announced that the existing Act will continue until such time an improved Act is introduced.
Commenting on the release of Land belonging to the Tamils in the North, the report mentioned that according to the Foreign Minister’s statement  as of 12th March 2019, the Government has released 88.87% of state land and 92.16% of private land held by security forces 
 The reform of the Muslim Marriage and Divorce Act (MMDA) has progressed. However, a Cabinet-approved proposal to amend the MMDA setting 18 years as the minimum age of marriage for both men and women still provides for 16 to 18-year-olds to wed with Qazi4 permission. Muslim women activists continue to highlight other issues with the reform proposals.
Urgent attention was needed in respect of violence against children including corporal punishment, sexual exploitation and abuse and economic exploitation, 
Although the Constitution of Sri Lanka provides for the right to equality without discrimination on the basis of race, religion, language, caste, sex, political opinion, or place of birth, there was no effective legislation and remedies. There was no specific anti-discrimination law in place, nor a law guaranteeing prohibition of discrimination with respect to employment and occupation.
There was no legislation ensuring equal remuneration for men and women for work of equal value and no effective protection of workers against sexual harassment. 
Report praised Sri Lanka being the first South Asian nation to publicly destroy ivory obtained through elephant poaching. 
All the comments made in the Report about the rights are within the scope of the 27 international conventions Sri Lanka signed and did not go beyond those.
Report pointed out the economic benefits Sri Lanka got as a result of GSP+ concessions.
 “Sri Lanka’s overall trade grew by 3% between 2017 and 2018 to € 29.1 billion, with an overall trade deficit of € 9 billion. In 2018, the EU was Sri Lanka’s largest trading partner with 16% of the total (€ 4.7 billion), ahead of India (14.6%), China (13.4%) and the USA (10.2%). The EU is by far Sri Lanka’s main export destination with over 30% of the total (€ 2.8 billion), followed by the USA (26%) and India (6.6%). In terms of imports, China is the largest source with 19%, followed by India (18.5%) and the EU (9.2%)”
 “A majority (84% in 2018) of Sri Lankan imports to the EU are GSP+ eligible. However, the utlilisation rate (the proportion of EU imports from Sri Lanka that actually benefitted from GSP+ preferences) has room for improvement at under 60%. Nonetheless, there has been an upward trend in utilisation rates over the past three years. Sri Lankan imports under GSP+ are concentrated in apparel and clothing (54%) and rubber (19%). “ 
We know the slow phase under which the previous government operated in implementing these basic rights of the people. On one hand we should be ashamed of the current situation where we have to secure the basic rights of our own citizens as a democracy under the supervision of the UN and the EU. In fact, the UN and the EU work hard to safeguard the sovereignty of our own citizens whereas certain parties with vested interests within our country are obstructing this process in the very notion of protecting the sovereignty of the country. This Report elaborated the widespread nature of the effects of 27 international conventions Sri Lanka signed and  it quantified the economic benefits Sri Lanka obtained. It reveals that the responsibility of the current government is to take forward the work carried out by the previous government rather than reversing the trend and obstructing the process.

අයිතිවාසිකම් වැඩි වුණොත් ආර්ථිකය ගොඩයනවා

2018-2019 ජී එස් පී ප්ලස් ප්‍රගති වාර්තාව

යුරෝපා කොමිසම විසින් 2020 පෙබරවාරි 10 වන දින ශ්‍රී ලංකාවේ වර්ෂ 2018-2019 කාලය තුළ GSP+ ක්‍රියාකාරීත්වය සහ ශ්‍රී ලංකාව අත්සන් කළ සම්මුතීන්වල ක්‍රියාකාරීත්වය පිළිබඳ වාර්තාවක් ඉදිරිපත් කර තිබේ.

සිවිල් සහ දේශපාලන අයිතීන් පිළිබඳ ජ්‍යාත්‍යන්තර සම්මුතිය, වධහිංසාවට ලක්කිරීමට එරෙහි ජාත්‍යන්තර සම්මුතිය සහ ළමුන්ගේ අයිතිවාසිකම් පිළිබඳ සම්මුතිය යන ශ්‍රී ලංකාව විසින් අත්සන් කරන ලද ජාත්‍යන්තර සම්මුතීන්ට අනුකූලව ක්‍රියා නොකිරීම හේතුවෙන් ශ්‍රී ලංකාවට යුරෝපා සංගමය මගින් ලබාදුන් GSP+ සහනය වර්ෂ 2010 දී අත්හිටුවන ලදී.

GSP+ යටතේ ශ්‍රී ලංකා අපනයනවලට යුරෝපා සංගමය මගින් ප්‍රදානය කළ තීරු බදු සහනය අනුව බොහෝ භාණ්ඩවලට කිසිම තීරුබදු අයකිරීමක් නොකෙරුණි. එමෙන්ම ශ්‍රී ලංකාවෙන් යුරෝපා සංගමයට අපනයනය කරන භාණ්ඩ ශ්‍රී ලංකාවේ මුළු අපනයනයෙන් 1/3 ක් පමණ විය. එවකට තිබූ ආණ්ඩුව GSP+ සහනය ලබාදීම වෙනුවෙන් යුරෝපා සංගමය විසින් පනවන ලද කොන්දේසි අනුව කටයුතු කිරීමේදී ශ්‍රී ලංකාවේ ස්වෛරීත්වය කැප කිරීමට සිදුවන බව පවසමින් එම සහනය නැවත ලබා ගැනීම වෙනුවෙන් උත්සහායක් ගත්තේ නැත.

යුරෝපා සංගමය ඉල්ලා සිටියේ GSP+ සහනය ලබාදීම වෙනුවෙන් ශ්‍රී ලංකාව විසින් එවකට එකඟවී අත්සන් කර තිබුණු ජාත්‍යන්තර සම්මුතීන් 27 ක් සක්‍රිය ලෙස ක්‍රියාත්මක කරන ලෙසය.

ශ්‍රී ලංකාව විසින් අත්සන් කර තිබූ ජාත්‍යන්තර සම්මුතීන් බලාත්මක කිරීම සඳහා ගාස්තුවක් හෝ කප්පමක් හෝ වශයෙන් ශ්‍රී ලංකාවට GSP+ සහනය ලබාදීමට එනම් ශ්‍රී ලංකාවෙන් යුරෝපා සංගමයට අපනයනය කරන භාණ්ඩ බොහොමයක තීරුබදු ඉවත් කිරීමට යුරෝපා සංගමය කැමැත්ත ප්‍රකාශ කිරීම හරහා මතුවන ශ්‍රී ලංකාවේ ජාත්‍යන්තර ප්‍රතිරූපය කෙබඳුද? ශ්‍රී ලංකාව ජාත්‍යන්තර සම්මුතීන්ට අත්සන් කලේ නම් ඒවා ක්‍රියාත්මක කළ යුතුය. කිසිවකු විසින් ඒ සඳහා කප්පම් ගෙවිය යුතු නොවේ. මෙම සම්මුතීන් මගින් ශ්‍රී ලංකාවේ සහ ශ්‍රී ලාංකිකයන්ගේ මානව හිමිකම්, කම්කරු අයිතිවාසිකම්, යහපාලනය, පරිසරය සහ ධරණීය සංවර්ධනය යන කරුණු ආවරණය වේ. මේ සම්මුතීන් ක්‍රියාත්මක කිරීම මගින් සහන සැලසෙන්නේ ශ්‍රී ලංකාවට සහ ශ්‍රී ලාංකිකයන්ටයි. යුරෝපා සංගමයට නොවේ. එපමණක් නොවේ. GSP+ සහනය මගින් නැවත ශ්‍රී ලංකා ආර්ථිකයට සහ ශ්‍රී ලාංකිකයන්ට ප්‍රතිලාභ ලැබේ.

ප්‍රජාතාන්ත්‍රික රාජ්‍යයක ප්‍රධාන කුළුණු තුනක් තිබේ. එනම් විධායකය, ව්‍යවස්ථාදායකය සහ අධිකරණයයි. එයට අමතරව මාධ්‍යය ද ක්‍රියාත්මක වේ. මෙයින් එක් ආයතනයක් විසින් අනෙක් ආයතන අතික්‍රමණය කිරීම වැළැක්වීම සඳහා ව්‍යවස්ථාවට සංවරණ සහ තුලන හඳුන්වාදී ඇත. මේ මගින් ජනතාව සතු ස්වෛරීත්වය ආරක්ෂා වී තිබේ. යුරෝපා සංගමයේ හෝ එක්සත් ජාතීන්ගේ හෝ ක්‍රියාවන් ව්‍යවස්ථාවට පරිබාහිරව ජනතාව මර්දනයෙන් වැළැක්වීම සඳහා ඇතිවූ යම් සංවරණ සහ තුලන ක්‍රියාවලියකි. ජනතාව මර්දනයෙන් වැළැක්වීම මගින් ඔවුන්ගේ ස්වෛරීත්වය ආරක්ෂා වේ.

පසුගිය යහපාලන ආණ්ඩුව විසින් එතෙක් පැවති ක්‍රියාපිළිවෙළ ආපසු හරවා නැවත GSP+ සහනය ලබාගෙන ශ්‍රී ලංකාව අත්සන් කළ ජාත්‍යන්තර සම්මුතීන් ක්‍රියාත්මක කිරීම අරඹන ලදී. මේ අනුව ශ්‍රී ලාංකිකයන්ට ද්විත්ව සහනයක් ලැබිණ. එනම් තීරුබදු සහනය සහ මේ සම්මුතීන් රට තුළ ක්‍රියාත්මක වීම මගින් ලැබෙන නිදහසේ සහනයයි.

යුරෝපා සංගමයේ වාර්තාව නිකුත් වන්නේ පසුගිය වසර දෙකේ ප්‍රගතිය සමාලෝචනය කිරීම සඳහාය. මෙම වාර්තාව බොහෝ සෙයින්ම අදාළ වනුයේ පසුගිය ආණ්ඩු කාලයටයි. වාර්තාව මගින් ආණ්ඩුවේ සාධනීය ක්‍රියා ප්‍රශංසාවට ලක් කර ඇති අතර වඩා දියුණු කළ යුතු අංග අවධානයට ලක් කර තිබේ.

“ශ්‍රී ලංකාව බොහෝ සාධනීය පියවර ගෙන ඇත: අතුරුදහන්වූවන්ගේ කාර්යාලය සහ හානිපූරණය සඳහා වන කාර්යාලය පිහිටුවා තිබීම; වධහිංසාවට එරෙහි එක්සත් ජාතීන්ගේ සම්මුතියේ විකල්ප කෙටුම්පත අනුමත කිරීම; බලහත්කාරයෙන් අතුරුදහන් කරවූවන් සම්බන්ධ පනත සහ තොරතුරු දැනගැනීමේ පනත සම්මත කර ගැනීම; මගින් විනිවිදභාවය සහ ප්‍රජාතන්ත්‍රවාදය උදෙසා බලවත් කැපවීමක් පෙන්නුම් කරයි. එනමුත් විශේෂයෙන්ම වගවීමේ ක්‍රියාවලිය සම්බන්ධව ප්‍රගතිය ස්ථාවර නැත. පාස්කු ඉරිදා ප්‍රහාර වලින් පසුව සුළු ජාතීන්ගේ තත්ත්වය නොසන්සුන් වී ඇත. වධහිංසාවට ලක්වීම වැළැක්වීම න්‍යාය පත්‍රයේ ඇත. එනමුත් වගවීම සම්බන්ධයෙන් වන ක්‍රියාකාරකම් ඉක්මන් කළ යුතුව ඇත.”

“සමස්තයක් වශයෙන් වර්ෂ 2015 සිට ශ්‍රී ලංකාවේ මානව හිමිකම්වල සහ යහපාලනයේ වර්ධනයක් පෙන්නුම් කරයි. එනමුත් අසතුටුදායක තත්ත්වයන් කිහිපයක් තිබේ.”

පසුගිය ජනාධිපතිවරණයෙන් පසුව සිවිල් සමාජයට සහ මානව හිමිකම් සුරකින්නන්ට ක්‍රියාත්මක වීමට තිබූ අවකාශය අවහිර නොකිරීම පිළිබඳව වාර්තාව ප්‍රශංසා කරයි. එනමුත් දිගටම එක්සත් ජාතීන් සමඟ එක්ව කටයුතු කිරීමේ අවශ්‍යතාවද ජාත්‍යන්තර මානව හිමිකම් කොමිසමේ 30/1 යෝජනාව ක්‍රියාත්මක කිරීමේ අවශ්‍යතාවද වාර්තාව පෙන්වා දෙයි.

මේ අතර ශ්‍රී ලංකාවේ සම සහභාගිත්වයෙන් මානව හිමිකම් කොමිසමට ඉදිරිපත් කරන ලද මෙම යෝජනාවෙන් ඉවත්වන බව ශ්‍රී ලංකා ආණ්ඩුව පසුගියදා නිවේදනය කළේය.

ළමා ශ්‍රමය නැති කිරීම, කම්කරු අයිතිවාසිකම් ගෘහස්ථ හිංසනය සහ කාන්තා දේශපාලන නියෝජිතයන්ට හිමි පංගුව සම්බන්ධ කාරණා වලදී ප්‍රගතියක් පෙන්නුම් කර ඇතැයි වාර්තාව සඳහන් කරයි.

විධායක ජනාධිපති ක්‍රමය සංශෝධනය කළ එමෙන්ම ප්‍රජාතන්ත්‍රවාදය සහ යුක්තිය සුරැකීම සම්බන්ධයෙන් ප්‍රමුඛ කාර්ය භාරයක් ඉටුකරන යම් ආයතනවල ස්වාධීනත්වය තහවුරු කරන 19 ව්‍යවස්ථා සංශෝධනය අහෝසි කිරීමේ වෑයම පිළිබඳව වාර්තාව කනස්සල්ල පළ කරයි.

ඥානසාර හිමියන්ට සමාව දීම ගැන සඳහන් කරන වාර්තාව එය අධිකරණයටත් ඥානසාර හිමියන්ගේ ක්‍රියා හේතුවෙන් වින්දිතයන් වූ මුස්ලිම්වරුන්ටත් කනස්සළු දායක පණිවිඩයක් නිකුත් කරන බව කියයි. එමෙන්ම ශක්තික සත්කුමාර අත්අඩංගුවට පත්වීම පිළිබඳවද වාර්තාව සඳහන් කරයි.

ආගමික නිදහස ගැන කටයුතු කරන රාජ්‍ය නොවන සංවිධානයක් වර්ෂ 2018 ජනවාරි මස සිට ක්‍රිස්තියානීන් ඉලක්ක කරගෙන සිදුකළ තර්ජනය කිරීම් සහ ආගමික මෙහෙයන් කඩාකප්පල් කිරීම් 86 ක් වාර්තා වූ බව සඳහන් කරන එම වාර්තාව 2019 අප්‍රේල් 14 වනදා මෙතෝදිස්ත සභාවේ ආගමික මධ්‍යස්ථානයකට ගල් සහ රතිඤ්ඤා වලින් කළ පහර දීම ගැනද සඳහන් කරයි.

පසුගිය ආණ්ඩුව ත්‍රස්තවාදය වැළැක්වීමේ පනත ඉවත් කර වෙනත් පනතක් ගෙන ඒමට උත්සහා ගත්තත් පවතින ආණ්ඩුව වැඩිදියුණු කළ කෙටුම්පතක් ඉදිරිපත් කරන තෙක් පවතින පනත පවත්වාගෙන යන බව ප්‍රකාශ කළ බවද වාර්තාව සඳහන් කරයි.

ද්‍රවිඩ ජනතාවගේ ඉඩම් නිදහස් කිරීම ගැන සඳහන් කරන වාර්තාව විදේශ ඇමතිවරයාට අනුව 2019 මාර්තු 12 වන විට රාජ්‍ය ඉඩම් වලින් 88.87% ක්ද පුද්ගලික ඉඩම් වලින් 92.16% ක් ද නිදහස් කර ඇති බව කියයි.

මුස්ලිම් විවාහ සහ දික්කසාද පනත සංශෝධනය කිරීමේ අවශ්‍යතාව ද එමගින් අවධාරණය කරයි.

එමෙන්ම ළමයින්ට එරෙහිව ක්‍රියාත්මක වන ශාරීරික දඬුවම් ද ලිංගික අපයෝජනයද ආර්ථික සූරා කෑම ද සම්බන්ධයෙන් ඉක්මන් අවධානයේ අවශ්‍යතාව වාර්තාව අවධාරණය කරයි.

ශ්‍රී ලංකාවේ ව්‍යවස්ථාවේ සඳහන් වන ජන වර්ගය සහ ආගම වැනි කරුණු හෝ වෘත්තීය සමිතියකට අයත්වීම සහ දේශපාලන මත දැරීම හෝ වැනි විවිධ කාරණා සම්බන්ධ වෙනස්කොට සැලකීමට එරෙහි නීතියක් නොමැතිකම වාර්තාව පෙන්වා දෙයි.

එමෙන්ම ස්ත්‍රීන්ට සහ පුරුෂයන්ට සමාන වැඩට සමාන වැටුප් ලබා දිය යුතු බවට නීතියක්ද නොමැති බව ද ලිංගික අතවර වලින් සේවක සේවිකාවන් ආරක්ෂා කිරීමට ප්‍රතිපාදන නොමැති බවද වාර්තාව පෙන්වා දෙයි.

එමෙන්ම අල්ලා ගත් නීති විරෝධී ඇත්දළ තොගයක් ප්‍රසිද්ධියේ විනාශ කිරීම පිළිබඳව වාර්තාව ප්‍රශංසා කරයි.

ශ්‍රී ලංකාවට GSP+ සහනය වෙනුවෙන් ලැබුන ආර්ථික ප්‍රතිලාභ වාර්තාවේ පහත දැක්වෙන ලෙස පෙන්වා දී ඇත.

“ශ්‍රී ලංකාවේ සමස්ත වෙළෙඳාම 2017 සිට 2018 දක්වා යුරෝ බිලියන 29.1 කින් වැඩිවී ඇත. මෙය 3%ක වර්ධනයකි. සමස්ත වෙළෙඳ ශේෂයේ හිඟය යුරෝ බිලියන 9 කි. වර්ෂ 2018 දී යුරෝපා සංගමය ශ්‍රී ලංකාවේ විශාලතම වෙළෙඳ සහකරුවා විය. මෙය ශ්‍රී ලංකාවේ සමස්ත වෙළෙඳාමෙන් 16% කි. වටිනාකම යුරෝ බිලියන 4.7 කි. මේ අනුව යුරෝපා සංගමය ඉන්දියාවටද(14.6%) චීනයටද (13.4%) ඇමෙරිකාවටද (10.2%) වඩා ඉදිරියෙන් සිටී. මෙතෙක් දුරට ශ්‍රී ලංකාවේ අපනයන වලින් වැඩිම ප්‍රමාණයක් එනම් 30% කට වඩා වැඩි ප්‍රමාණයක් ආනයනය කරන්නේ යුරෝපා සංගමයයි. වටිනාකම යුරෝ බිලියන 2.8 කි. ඇමෙරිකා එක්සත් ජනපදයට ශ්‍රී ලංකාවේ අපනයන 26% ක්ද ඉන්දියාවට6.6% ක්ද වේ. ශ්‍රී ලංකාවේ ආනයන සම්බන්ධයෙන් චීනය ඉදිරියෙනි.

වාර්තාව සඳහන් කරන සමස්ත වෙළෙඳාම යනු ආනයන සහ අපනයන යන දෙකේ එකතුවයි.

එමෙන්ම ශ්‍රී ලංකාවේ යුරෝපා සංගමයට කෙරෙන අපනයන වලින් වැඩි කොටස එනම් 2018 දී 84% ක් GSP+සහනය සඳහා සුදුසුකම් ලබන්නේ වුවද එය පාවිච්චි කිරීමේ අනුපාතය (එනම් ශ්‍රී ලංකාවේ සහනය සඳහා සුදුසුකම් ලබන අපනයන වලින් සහනය ලැබූ අපනයන අනුපාතය) 60% කින් පමණ වැඩි කිරීමේ අවකාශයක් තිබේ. කෙසේ නමුත් මෙම පාවිච්චි කිරීමේ අනුපාතය පසුගිය වසර තුනේ අනුක්‍රමයෙන් වැඩිවී තිබේ. GSP+ සහනය යටතේ ශ්‍රී ලංකාවෙන් වැඩිපුරම අපනයනය කෙරෙන්නේ නිමි ඇඳුම් (54%) සහ රබර්(19%) ය.

පසුගිය ආණ්ඩුව මෙම මූලික අයිතිවාසිකම් සුරක්ෂිත කිරීමේලා දැක්වූ මන්දගාමී ස්වරූපය අපි දනිමු. එක් අතකින් අපගේ පුරවැසියන්ගේ මූලික අයිතීන් සුරැකීම සම්බන්ධයෙන් එක්සත් ජාතීන් සහ යුරෝපා සංගමයේ උනන්දු වීම සම්බන්ධව අපි ලැජ්ජාවට පත් විය යුතු වෙමු. ඇත්ත වශයෙන්ම එක්සත් ජාතීන් සහ යුරෝපා සංගමය අප පුරවැසියන්ගේ ස්වෛරීත්වය සුරැකීමට උත්සාහ කරන අතර මෙරට සමහර කොටස් රාජ්‍යයේ ස්වෛරීත්වය සුරැකීමේ මුවාවෙන් එයට විරුද්ධ වෙති. මෙම වාර්තාව ශ්‍රී ලංකාව විසින් අත්සන් කරන ලද ජාත්‍යන්තර සම්මුතීන්වල ක්‍රියාකාරීත්වය සම්බන්ධ පැතිරුණු ස්වභාවයද ආර්ථික ප්‍රතිලාභවල වර්ධනයද පෙන්නුම් කරයි. එමෙන්ම වර්තමාන ආණ්ඩුවේ වගකීම වන්නේ පසුගිය ආණ්ඩුවේ ක්‍රියාපිළිවෙල ඉදිරියට ගෙනයාම මිස එය කඩාකප්පල් කර ප්‍රවාහය ආපසු නොහැරවීම බව මෙම වාර්තාව මගින් පෙන්වා දෙනු ලැබේ. එය මේ ආණ්ඩුව අපේක්ෂා කරන සීඝ්‍ර ආර්ථික සංවර්ධනය සඳහා හොඳම මාවතයි.

Our Heritage Is Kandyan Law; Not Roman Dutch Law As Rathana Thero Thinks

There were four bills presented by Private Members to the Parliament on January 8, 2020 (One Bill is to be presented) which were already advertised in the gazette. They were to repeal the Kandyan Marriage and Divorce Act No 44 of 1952; to repeal the Muslim Marriage and Divorce Act No 13 of 1951; to amend the Marriages (General) Ordinance No. 19 of 1907; to amend the Marriages Registration Ordinance; and to introduce a minimum age of marriage in Sri Lanka. First three were/will be presented to the parliament by Ven. Athuraliye Rathana Thero M.P. and the other two were presented by Dr.(Mrs.) Thusitha Wijemanna M.P.
In Sri Lanka the Common law applicable to marriage and divorce is based on the Roman Dutch law. This Common law is in the Marriages (General) Ordinance No. 19 of 1907. In addition to that there is Kandyan Marriage and Divorce Act No 44 of 1952 applicable for the people living in the Kandyan Districts. For the Muslims in Sri Lanka the applicable law is Muslim Marriage and Divorce Act No 13 of 1951 (MMDA). The intention of the proposed amendments is that to make Roman Dutch law is only law applicable to marriage and divorce in Sri Lanka and to make the minimum age for marriage is 18years.

Minimum age of the marriage
According to Section 23 of MMDA , a marriage contracted by a Muslim girl who has not attained the age of twelve years shall not be registered under this Act unless the Quasi for the area in which the girl resides has, after such inquiry as he may deem necessary, authorized the registration of marriage.
According to Section 15 of Marriage Registrations Ordinance 19 of 1907, lawful age of marriage, in relation to a male was 16 years and in relation to a female was 12 years and if a female was a daughter of European or Burgher parents, the minimum age was 14 years. It was amended by Act No 18 of 1995 raising the minimum age of both male and female to 18 years irrespective of the ethnicity.
According to Section 66 of the Marriage and Divorce (Kandyan) Act 44 of 1952, lawful age of marriage, in relation to a male was 16 years and in relation to a female was 12 years. This was amended by Act No 19 of 1995 raising the minimum age of both male and female to 18 years.
Therefore, not only the Muslims but also all the others thought in the same line in relation to the minimum age of the marriage. All the others, other than Muslims changed it. The Muslim community should also fall in line with the changing environment. 
Kandyan Law
At the time of the arrival of the western invaders to Sri Lanka, the marriage and divorce practices and the relevant law was very liberal. According to Niti Nighanduwa which was believed to be written between 1769 and 1815 at Senkadagalapura, either the husband or the wife can disengage from the marriage bond. There were no barriers for disengagement. However, there were consequences. At the marriage the ownership of the properties of the husband and wife were kept separately with them. The wealth earned by both would be divided equally at the time of disengagement. If the disengagement of the marriage is executed by one party, then that party does not have any right of the assets of the other party. Niti Nighanduwa gives a detailed account of the family law prevalent during that time. Liberal nature of that law was confirmed by Robert Knox in his book.
According to Section 32, the dissolution of the marriage can be granted on any of the following grounds.
  • Adultery by the wife after marriage
  • Adultery by the husband coupled with incest or gross cruelty
  • Complete and continued desertion by the wife for two years
  • Complete and continued desertion by the husband for two years
  • Inability to live happily together, of which actual separation from bed and board for a period of one year shall be the test
  • Mutual consent 
These provisions although are liberal tried to impose conditions to the  provisions in  Niti Nighanduwa.
Roman Dutch Law
Colonial masters imposed a different law based on Roman Dutch Law on marriages and divorces for the people who lived outside of the Kandyan districts. These people were influenced and “cultured” by their colonial masters over centuries. Marriage was viewed as a sacred act by the Christians. Christian marriage is a union between a man and a woman, instituted and ordained by God, for the lifelong relationship between one man as husband and one woman as wife. This expectation of the lifelong relationship was being reflected in the Roman Dutch divorce law.
According to Section 19 of Marriage Registrations Ordinance 19 of 1907, No marriage shall be dissolved during the lifetime of the parties except by judgement of divorce a vinculo matrimonii pronounced in some competent court. Such judgement shall be founded either on the ground of adultery subsequent to marriage or of malicious desertion or of incurable impotency at the time of such marriage.
This is legalization of the will of the God. This conservative law was based on the Victorian culture prevailed in Europe at that time. Present divorce laws in the Europe are very liberal and are in line of the Kandyan law. Present Sinhala society is also in the process of absorbing old Kandyan values of marriages and divorces.  Rathana Thero and his ideological group of Sinhala Buddhism are unknowingly trying to uphold a law which is based on colonial Christian values while trying to abandon a law which is based on Sinhala Buddhist heritage and the values. What an irony. 
If Rathana Thero wants to uphold Sinhala Buddhist culture, what he should do is to repeal the Marriage Registrations Ordinance 19 of 1907 and make the Marriage and Divorce (Kandyan) Act 44 of 1952 the Common law of sri Lanka in relation to marriage and divorce.  
Muslim Law
In Sri Lanka the amendments to MMDA were discussed. Muslim women were agitating against the provisions of the Act for more than 30 years. Successive governments appointed different committees. Committee headed by Justice Saleem Marsoof was appointed in 2009 and the report was issued in July 2019. Although Muslim Parliamentarians agreed to 14 recommendations, it is reported that All Ceylon Jamiyyathul Ulama (ACJU) was against these recommendations. 
Muslim women request that the minimum age of marriage for all Muslims must be 18 years without any exceptions; women should be eligible to be appointed as Quazis, as Members of the Board of Quazis, Marriage Registrars, and Assessors (jurors); the MMDA must apply uniformly to all Muslims without causing disadvantage to persons based on sect or madhab; signature or thumbprint of bride and groom is mandatory in all official marriage documentation to signify consent; registration should be required for legal validity of marriage; adult Muslim women are entitled to equal autonomy and need not require the ‘permission’ by law of any male relative or Quazi to enter into a marriage;  Talaaq (divorce) and Faskh (annulment) rights between women and men must be equal; Procedures for divorce initiated by men and women must be the same, including appeal process ; and to revise the Quazi court system to ensure a competent system with improved access to justice for women and men.
These are very reasonable demands. Civil Society in Sri Lanka is also opposing to MMDA in the same lines namely discrimination against children and women. However nationalistic Sinhala Buddhists opposed to MMDA on the grounds that Sri Lanka should have only one law and there should not be different laws for different ethnicities. Therefore, the opposition to MMDA by the Muslim women and the Civil Society and the opposition to the same by the nationalistic Sinhala Buddhists are coming from different reasons and from different backgrounds. The latter, although comes with the frontline of one country- one law in the pretext of unification, is in fact targeting discrimination on the Muslims.  
Conclusion
Law reflects the culture of the people. Muslims in Sri Lanka over centuries preserved their cultural identity while mixing with the other communities. 
In her book, The Muslims of Sri Lanka- one thousand years of ethnic harmony 900-1915, Lorna Dewaraja stated as follows.
“…This is striking example of the policy of live and let live characteristic of Sinhala society at that time. Muslims, Hindus, and Buddhists were voluntary participants in the festivities of the Embekke devala and none of those groups lost their cultural identity in the process”
Law makers  should never interfere with Muslim  law which is based on their cultural heritage. People should oppose the Muslim law  if there are any violations of human rights or any discrimination against the weak in the name of such culture and laws. If Rathana Thero wants to have a one law for marriage and divorce, he should draft a new law applicable to the current society eliminating the destructive aspects of Roman Dutch law.
